Missing session

The Sinjar Center – Baghdad Women Association implemented the missing session inside the Sinjar Center on April 12, 2023, with the participation of 13 beneficiaries. The beneficiaries who were in need of counseling regarding the missing person case were contacted, and it was explained to them that the probability of success of the case reaches 98%, because the beneficiary is not wanted by the security authorities. With regard to legal rights and duties, It was made clear to the beneficiary that the person who will file the case before the Investigation Court is a first-degree relative, and that there are no risks to the beneficiary because he is not wanted by the security authorities. The relevant laws are also explained, as the Code of Criminal Procedure applies to the case. With regard to the relevant courts and departments, the beneficiary was informed of the need to refer to the Investigation Court at the police station and the Mukhtar, as well as the intelligence and national security departments to obtain security books. With regard to the procedures of the case, it begins with submitting a request for information before the investigating judge, in the presence of two witnesses, and recording the initial statement of the informant. The informant then presents the case before the investigating judge and pays the fee, and the above-mentioned procedures are followed. As for the legal options, the only option available to the beneficiary is to bring the case before the investigation court, and there are no other options. The required supporting documents are all the official documents of the beneficiary and the informant, such as the identity card, the Iraqi nationality and the housing card, and they are attached to the case file. The expected duration of this case is between six months to a year, due to the difficulty of completing the books sent to the security authorities, which take a long time to complete. In addition to the publication in two official newspapers, which causes delays in completing the case.
